Court Strikes Out Afe Babalola’s Defamation Suit Against Dele Farotimi
Defence counsel Olumide Fusika did not oppose the move, allowing Justice Babs Kuewumi to formally dismiss the case.
Ado-Ekiti, Ekiti State- The Federal High Court in Ado-Ekiti on Wednesday dismissed the defamation suit filed by legal luminary Afe Babalola against activist and author Dele Farotimi.
The prosecution, led by Samson Osobu, informed the court of the decision to withdraw the case, citing Section 108(1)(2)(a) of the Administration of Criminal Justice Act 2015.
“The nominal complainant [Babalola] has expressed his desire to discontinue the case,” Mr Osobu stated, urging the court to strike out the charge.
Defence counsel Olumide Fusika did not oppose the move, allowing Justice Babs Kuewumi to formally dismiss the case.
The withdrawal follows a reconciliation brokered by the Ooni of Ife, Oba Adeyeye Ogunwusi, and other monarchs, after which Mr Babalola publicly forgave Mr Farotimi and pledged to drop the charges.
Mr Farotimi had been facing legal action over alleged defamatory statements in his book, Nigeria and Its Criminal Justice System.
